Overview
These Hosting Terms of Service ("Hosting Terms") constitute the entire agreement between SHOMPTON, LLC ("Shompton," "we," "us," or "our") and the hosting account holder ("Customer," "you," or "your") for web hosting and related services.
By purchasing or using Shompton hosting services, you agree to be bound by these Hosting Terms and our Acceptable Use Policy.
Important: These terms apply to hosting clients only. Website visitors should refer to our Website Terms of Service.
Services Provided
Shompton provides the following hosting services:
- Web Hosting: Server space and bandwidth for hosting websites and applications
- DNS Management: Domain name system configuration and management
- SSL Certificates: Security certificates for encrypted connections
- Email Hosting: Email accounts and mail server access (where applicable)
- Technical Support: Assistance with hosting-related technical issues
- Performance Monitoring: Server uptime and performance tracking
Specific services included in your plan are detailed in your service agreement or order confirmation.
Payment and Billing
Payment Terms
All hosting accounts are set up on a pre-payment basis. We accept payment via:
- Credit cards (Visa, MasterCard, American Express, Discover)
- PayPal
- ACH/Bank transfer (for annual plans)
Billing Cycle
Payment is due on the anniversary of your account establishment date. Billing cycles may be:
- Monthly
- Quarterly
- Semi-annually
- Annually
Late Payment
If payment is not received within 10 days of the due date, your account may be suspended. A $30 reconnection fee applies to accounts suspended for non-payment.
Price Changes
Pricing is guaranteed for the term of your pre-payment period. We reserve the right to change prices for renewal periods with 30 days' notice.
Setup Fees
Setup fees may apply to new accounts or major account changes. Setup fees are non-refundable.
Acceptable Use
Your use of Shompton hosting services must comply with our Acceptable Use Policy. Prohibited activities include but are not limited to:
- Illegal content or activities
- Spam or unsolicited commercial email
- Malware, viruses, or malicious code
- Unauthorized access attempts
- Resource abuse or excessive bandwidth usage
- Content that violates intellectual property rights
Violation of the Acceptable Use Policy may result in immediate suspension or termination of services.
Data Backup Responsibility
Customer Responsibility: You are solely responsible for backing up your data regularly. While we may perform server-level backups for disaster recovery purposes, these backups are for our operational use only and are not guaranteed to be available to you.
Backup Services
If you have purchased backup services from Shompton:
- Backups are performed according to your service plan
- Backup retention periods vary by plan
- Restoration requests may incur fees
- We do not guarantee successful restoration of all data
Data Loss
Shompton is not liable for any data loss, regardless of cause. Failure to maintain regular backups may limit any claims for damages.
Security
Customer Responsibilities
You are responsible for:
- Maintaining secure passwords and access credentials
- Keeping software and applications up to date
- Monitoring your account for unauthorized access
- Promptly addressing security vulnerabilities
- Notifying us immediately of any security breaches
Security Breach Recovery
If your account is involved in a security breach or attack:
- We may suspend your account immediately to protect our infrastructure
- You will be charged $100/hour for security breach investigation and recovery
- You are responsible for costs to remove our IP addresses from blacklists
- You must cooperate with our investigation
Suspension, Termination, and Cancellation
Suspension by Shompton
We reserve the right to suspend your account immediately without prior notice if:
- You violate these Hosting Terms or the Acceptable Use Policy
- Your account poses a security risk to our infrastructure
- Payment is more than 10 days overdue
- We receive a legal order requiring suspension
Termination by Shompton
We may terminate your account for:
- Repeated violations of our policies
- Illegal activities
- Failure to cure violations after notice
Upon termination, no refund will be provided, and all files, email, and account data will become property of Shompton and subject to deletion.
Cancellation by Customer
Refund Policy: You may cancel within 48 hours of initial service activation for a full refund minus setup fees. Cancellations after 48 hours are not eligible for refunds.
Cancellation Notice: You must provide written notice of cancellation at least 5 days before your next billing date. Send cancellation requests to support@shompton.com from your account email address.
Disclaimers
HOSTING SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
Shompton disclaims all warranties, including but not limited to:
- Warranties of merchantability or fitness for a particular purpose
- Warranties of uninterrupted or error-free service
- Warranties regarding data security or backup integrity
- Warranties of access to third-party networks or services
Service Availability
While we strive for maximum uptime, we do not guarantee 100% availability. Scheduled maintenance, emergency repairs, and factors beyond our control may cause service interruptions.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHOMPTON SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL.
This limitation applies to damages arising from:
- Service interruptions or downtime
- Data loss or corruption
- Security breaches
- Unauthorized access to your account
- Errors or omissions in our services
- Third-party actions or failures
Our total liability for any claim related to hosting services shall not exceed the amount you paid for services in the 12 months preceding the claim, or $500, whichever is less.
Indemnification
You agree to indemnify, defend, and hold harmless Shompton, its officers, directors, employees, and agents from all claims, damages, losses, and expenses (including reasonable attorney fees) arising from:
- Your use of hosting services
- Content you host on our servers
- Your violation of these Hosting Terms or the Acceptable Use Policy
- Your violation of any third-party rights
- Security breaches originating from your account
Modifications to Terms
We reserve the right to modify these Hosting Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of hosting services after modifications constitutes acceptance of the updated terms.
For material changes that adversely affect your rights, we will provide 30 days' notice via email to your account email address.
